Rubitech Luctron Warranty Statement
Rubitech Luctron B.V. (hereafter Rubitech Luctron) guarantees, in accordance with the conditions in the Warranty Statement to the customer, that all Intenz highbay LED luminaires supplied with and without Coolheart Technology TM are free from defects in material and production upon delivery. This warranty applies only to luminaires produced by Rubitech Luctron and purchased from Rubitech Luctron. Peripheral items and other materials, fuses and transistors that are on the driver, samples and remnant sales are not covered by this warranty. In addition to this Warranty Statement, the general terms and conditions of sale and delivery of Rubitech Group (General Terms and Conditions of Sale, filed with the court of Overijssel (location Zwolle) on October 23, 2012 with number 31/2012) apply. The warranty commences on the invoice date or, if this occurred earlier, the installation date, but in no case later than 6 months after the production date.
In addition to the standard warranty of 5 years for Coolheart Technology TM highbay LED fixtures and 3 years for highbay LED fixtures without Coolheart Technology TM, Rubitech Luctron will grant the buyer extended warranty according to the following procedure: For Intenz highbay LED fixtures with Coolheart Technology TM applies after registration a 10-year warranty and a 5-year warranty for the Intenz LED highbay fixtures without Coolheart Technology TM. The registration must be completed within 30 days after delivery of the products. If the registration does not take place or takes place incorrectly, only the standard warranty is valid. - The customer must have purchased the products directly from Rubitech Luctron or through a representative/ distributor (intermediary) who has been approved in writing by Rubitech Luctron in advance. If the intermediary has made the purchase in his own name at Rubitech Luctron, the relevant intermediary must make a claim under his own name under the current Warranty Statement and Rubitech Luctron is not liable towards the customer.
- Rubitech Luctron only provides a guarantee if the installation of the products in question has been completed in accordance with the Assembly Manual and the products are used within the specifications of the installation standards. Rubitech Luctron does not provide a guarantee if the limit values for ambient temperature and mains voltage have been exceeded, regardless of the extent to which. Rubitech Luctron only provides a guarantee if the maintenance instructions drawn up in the assembly instructions have been fully complied with. The guarantee also only applies if the customer has fulfilled all his/her payment obligations towards Rubitech Luctron and/or the relevant representative(s) according to the agreed payment term(s).
- Guarantee and liability are excluded in the event of defects and damage caused or increased by voltage peaks, overvoltage / undervoltage and ripple current control systems that exceed the limits of the products in question as stated in the Installation Manual. If water is found in a delivered product, it is excluded from the warranty. Also, applying modifications or adding material to the products, falling / bumping, improper or incorrect installation and/or operation or use of the products, or abnormal use of the products, leads to the cancellation of the warranty. Defects or damage that are the result of external calamity, force majeure, natural disasters, or lightning, are not covered by the warranty.
- The warranty for the Intenz luminaires fitted with Coolheart Technology TM applies up to a maximum of 50,000 burning hours.
The warranty for the Intenz luminaires without Coolheart Technology TM applies up to a maximum of 4,000 burning hours per year. - The warranty applies exclusively to material and manufacturing defects and is valid for the entire product, with the exception of the components, which are excluded in this Warranty Statement. Rubitech Luctron is not liable for guarantee if the damage and/or defect in the product is of minor importance, which applies in the event that:
– the failure rate is less than 0.2% per 1,000 burning hours
– a light fallback is measured of no more than 5% decrease in luminous flux per year
– there is a failure of a small number of LEDs in a product and/or
– the lumen flux and the power consumption show a deviation of a maximum of +/- 10% - The buyer must report the warranty claim in writing to Rubitech Luctron within 30 days after finding a defect and/or damage. After this period, the possibility to submit a warranty claim expires. If, in the opinion of Rubitech Luctron, insufficient information is provided, they may decide to reject the warranty claim. Minimum requires data are:
– article number and serial number (also possible through a photo)
– installation date, invoice/delivery note number
– information from other products that are installed as control and/or monitoring of the installed luminaires.
– detailed problem description and description of the surrounding environment together with the application of the fixture and photos of both the fixture and surrounding environment. - If the products have to be examined to further determine the nature of the warranty claim and/or to determine the defect and/or damage, Rubitech Luctron requests the defects to be returned to the point of sale of the purchase with sufficient postage.
- The replaced or repaired product retains the original warranty period. The remainder of the current warranty period remains applicable and is therefore not extended.
- No customer, intermediary or other third party is authorised, on behalf of Rubitech Luctron, to replace or expand the conditions of this Warranty Statement or the agreement.
- If Rubitech Luctron acknowledges the warranty claim, Rubitech Luctron will provide a replacement product or part or a credit note at its own discretion. It is possible that due to improvements in product or production, the replacement fixture may differ slightly from the defective one.
- Rubitech Luctron is not liable for labour costs, assembly/dismantling costs, loss of income or profit, damage to property or any other consequential damage, in whatever form. Rubitech Luctron is also not liable for the costs of obtaining access and installation of the products concerned as a result of research, and other costs not mentioned.
- If after investigation by themselves or third parties Rubitech Luctron does not acknowledge the warranty claim, the buyer will reimburse Rubitech Luctron for costs for the investigation in question (including in any case the work for the investigation, costs of third parties, storage and transport).
- The guarantees further apply on condition that the customer, upon first request by Rubitech Luctron, under penalty of forfeiting all liability of Rubitech Luctron, provides written proof of the fulfilment of the conditions stated in this Warranty Statement and/or absence of circumstances that result to the exclusion of the guarantee.
Rubitech Luctron will do all the necessary work and provide support that is required for the correct resolution and handling of warranty claims
The latest version of this Warranty Statement and the Installation Manual can be requested via info@rubitech.com. Upon request, Rubitech Luctron will send a copy of the general sales and delivery conditions of Rubitech Group. The Maintenance instruction manual is part of the Installation manual.
This Warranty Statement is valid for all Intenz highbay fixtures produced after the following serial number: 201934xxxxx.
This Warranty Statement has been translated from Dutch. In the event of uncertainties about the meaning and explanation of the text, only the Dutch version shall apply.
Dutch law applies to all our agreements. In the first instance, disputes are exclusively submitted to the Overijssel court (location Zwolle).
